These Terms govern your use of the Thiri Mingalar Zay mobile application on iOS and Android and related ecommerce services operated by Thiri Mingalar Zay — Japan Branch.

1. Agreement to Terms

By downloading, installing, accessing, or using the Thiri Mingalar Zay mobile application (the "App") or our website at https://thirimingalarzay.jp, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Services.

These Terms form a legally binding agreement between you and Thiri Mingalar Zay — Japan Branch ("we," "us," or "our"). Our Privacy Policy is incorporated into these Terms by reference and explains how we collect and use personal information.

2. Eligibility

You must be at least 18 years of age, or have verifiable parental or guardian consent, to use the Services. The Services are intended for customers residing in Japan who wish to purchase Myanmar-origin products. By using the App, you represent that you meet these requirements and that all registration information you provide is accurate and complete.

3. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, solely for personal, non-commercial shopping purposes. You may not:

  • Copy, modify, reverse engineer, or create derivative works of the App
  • Rent, lease, sublicense, or distribute the App to third parties
  • Use the App for any unlawful or unauthorized purpose
  • Remove or alter proprietary notices in the App

All rights not expressly granted are reserved by us and our licensors.

4. Account Registration and Security

To place orders, you must create an account with a valid email address and password. You agree to:

  • Provide accurate, current, and complete account information
  • Maintain the security and confidentiality of your password
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access or security breach

We may suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent or abusive activity.

5. Account Termination and Deletion

You may stop using the Services at any time. You may also request deletion of your account and associated personal data as described in our Privacy Policy (Section 9 — Account and Data Deletion), either through the App's account settings or by emailing support@thirimingalarzay.jp.

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Termination does not affect obligations incurred before termination (such as payment for completed orders).

6. Products, Pricing, and Availability

We offer curated products sourced from Myanmar for delivery within Japan. Product descriptions, images, weights, and prices are subject to change without notice. We strive for accuracy but do not warrant that descriptions or other content are error-free, complete, or current.

Prices are displayed in Japanese Yen (JPY). Applicable taxes and shipping fees are shown at checkout before you confirm your order. Product availability is not guaranteed until your order is confirmed.

Some products may be subject to import, food safety, or labeling regulations in Japan. You are responsible for ensuring that products you order comply with any applicable local requirements for your household's use.

7. Orders and Payment

When you submit an order, you make an offer to purchase the selected products. We reserve the right to accept or decline any order for any reason, including product unavailability, pricing errors, or suspected fraud. An order is confirmed only when you receive an order confirmation notification from us.

Payment must be completed at checkout using our supported payment methods. Payments are processed by third-party payment processors. By submitting payment information, you authorize us and our payment partners to charge the total order amount, including applicable taxes and shipping fees.

If a pricing or product description error is discovered after you place an order, we may cancel the order and issue a full refund.

8. Shipping and Delivery

We deliver to addresses within Japan only. Delivery times, carriers, and fees depend on your location and the products ordered. Estimated delivery dates shown at checkout are estimates only and are not guaranteed.

You are responsible for providing a correct and complete delivery address and for being available to receive perishable goods where applicable. We are not liable for delays or failed deliveries caused by incorrect address information, refusal of delivery, or events beyond our reasonable control (including weather, customs delays, or carrier disruptions).

Risk of loss for products passes to you upon delivery to the address you provide.

9. Returns, Refunds, and Cancellations

Cancellations: You may request cancellation of an order before it has shipped by contacting support@thirimingalarzay.jp with your order number. We will confirm whether cancellation is possible.

Returns and refunds: If you receive a damaged, defective, or incorrect item, contact us within 7 days of delivery with your order number and photos of the issue. We will review your request and, where appropriate, offer a replacement or refund to your original payment method.

Perishable goods: Fresh or perishable products may not be eligible for return unless damaged, defective, or incorrect upon arrival. Refund eligibility is determined on a case-by-case basis in accordance with applicable consumer protection laws in Japan.

Refunds, when approved, are processed within a reasonable period. Processing times by your bank or payment provider may vary.

10. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law
  • Attempt unauthorized access to our systems, accounts, or networks
  • Submit false, misleading, or fraudulent information or orders
  • Interfere with or disrupt the App, website, or servers
  • Scrape, harvest, or collect user data without authorization
  • Resell products purchased through the App for commercial purposes without our written consent
  • Use automated tools (bots) to access the Services without permission

11. Intellectual Property

The App, website, and all content — including logos, trademarks, text, images, product listings, and software — are owned by or licensed to Thiri Mingalar Zay — Japan Branch and protected by intellectual property laws. You may not use our branding or content without prior written consent.

12. Communications

By creating an account, you consent to receive transactional communications from us (order confirmations, delivery updates, and account-related notices) via email, push notification, or in-app message. You may opt out of non-essential marketing communications where offered, but you cannot opt out of transactional messages related to active orders.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that product descriptions will meet your specific expectations.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIRI MINGALAR ZAY — JAPAN BRANCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE RELEVANT ORDER IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) JPY 10,000.

Some jurisdictions do not allow certain limitations of liability; in those cases, our liability is limited to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify and hold harmless Thiri Mingalar Zay — Japan Branch and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

16. Governing Law and Disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Tokyo, Japan, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

Before initiating formal proceedings, you agree to contact us at support@thirimingalarzay.jp to attempt to resolve the dispute informally.

17. Changes to Terms

We may modify these Terms at any time. Updated Terms will be posted at https://thirimingalarzay.jp/terms with a revised "Last updated" date. Material changes may also be communicated through the App or by email where appropriate. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services and may request account deletion.

18. General Provisions

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Services.
  • No waiver: Failure to enforce any provision is not a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations in connection with a business transfer.

19. Apple App Store (iOS) Additional Terms

If you download the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Thiri Mingalar Zay — Japan Branch only, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App. Any support requests should be directed to support@thirimingalarzay.jp.
  • In the event of App failure to conform to any applicable warranty, you may notify Apple for a refund of the App purchase price (if any). Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or consumer protection claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.

20. Google Play Store (Android) Additional Terms

If you download the App from Google Play, the following additional terms apply:

  • These Terms are between you and Thiri Mingalar Zay — Japan Branch only, not Google LLC ("Google"). Google is not responsible for the App or its content.
  • Google has no obligation to provide maintenance or support for the App. Support requests should be directed to support@thirimingalarzay.jp.
  • Google is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement claims.
  • Your use of the App must comply with Google Play's Terms of Service and all applicable Google Play policies.
